Authorities say Smith's blood-alcohol level was over the legal limit when he crashed his vehicle in northeast Ohio last month. Smith sustained minor injuries in the Oct. 7 crash near Ashtabula, which is about 55 miles northeast of Cleveland. The State Highway Patrol says the 26-year-old Smith failed to negotiate a curve and drove into a culvert, flipping the car. The patrol confirms that Smith's blood-alcohol level was .093 at the time of the crash. The legal limit in Ohio is .08.
